Forgive me, but I searched and the search engine on MM isn't great, I didn't find anything, and I tried searching Google, but really nothing relevant. I had a model ask me about shooting some nudes, nothing porn like as I do not shoot such stuff, and not even like "full" nudes, lots of implied stuff. I do not do this for a living, but I thought I heard something that guys are legal at 17 and girls are at 18. Does anyone have any information on what is legit?

I bet you all have seen this question many times, I tried to look it up not to bug, but no luck and this is DEF something one would need to know. I am still hesitant anyways, even if legal, but I want to know, so I know.

it's not worth it. wait til she's 18 and can legally consent to having nude pictures up. You wouldn't want to run the risk of her accusing you of forcing her to do it or doing other things to her.

While it's not illegal, in most venues, for anyone at any age, shoot nude,  there are far too many negatives involved to make it worth anyone's while, including the model.  If you do decide to do so, be sure that no poses are 2257 worthy (almost impossible to do given the vagueness of the regulation, that you get an authorization to do the shoot signed by both the model and her parent or legal guardian.  Also be aware that even if you do all this and the other parent opposes the shoot you might very well find yourself enmeshed in legal entanglements either now or down the road.  For example, if the parents are involved in a divorce and a custody battle erupts, the shoot, however innocent, might become an argument regarding the fitness of the consenting parent and, bang! you're in the middle of it.

Also, be aware, when shooting anyone under 21, even if you do get a release, the model may, depending on venue, be able to disavow the contract when (s)he turns 21.

If you're seriously thinking about doing the shoot anyway,  one last suggestion:  Check with your own attorney first.  Don't rely on any advice you get here, including mine.

There are simply too many things that can go wrong and get you convicted as a sex offender, child porn producer or other crimes that you don't want to have on your record. Even if you are only charged and not convicted, it's a battle you don't want to fight and the damage to your reputation will never be repaired.

Have the Mom there and anytime you shoot anyone under 18, nude or not.  If Mom says OK, it's AOK.

But have them both sign the release, especially Mom.

There's absolutely nothing wrong with it either as long as it's not sexual in nature.  Make her proud.

This is a big problem,  watch the news how many people are getting arrested for taking photos of minors.  the legal age is 18 boys and girls, if you have a reputation and a business why would you risk it all for a job that could potentially have you lose everything.......  I had a similar situation a year ago and told the girl that she would have to bring her mother and father to the shoot, guess what they never showed up.  If they would have showed up I would have had them sign an official consent form for nude photography.  She ended up working with another photographer who was then arrested for taking photos of a minor, guess what it was a set up by local authorities.  I know of another guy who posted an ad on Craig list and was arrested by an under cover cop because he never checked for an ID before taking the photos of a minor who they brought to have seductive photos for her portfolio as a new model.  STAY AWAY FROM MINORS!!!!!!!!!!! when it comes to doing anything that you wouldn't do with your own child.

"For most photographers, shooting underage nudes or implieds is a bad business decision. Legality has less to do with it than can you take the scrutiny.

Photographer's that have shot underage girls in provocative poses or nude often have some fame or a reputation that gives them some insulation from witch hunts."

First thing you should ask yourself is "why"?  Why would you take any kind risk to shoot this model when there are many, many other models you could be shooting.  In my opinion, there is no good reason to take a chance shooting a 17 year old model nude or implied.

Even at eighteen it may be legal but the model is still fickled. I've had a couple contact me wanting to, then at the shoot it's "Well I want to but yet I don't. Ok, let's do it, no wait a minute." to make it easy I ended up shooting them clothed and told them to call me when they were certain.

Do you have any links to these stories?  I used to live in Texas and I stay on
top of local news.  Something like you mention would have been featured on
local news and made its way to Yahoo at some point.  As to arresting some goof
for not checking a ID.  I don't believe that for a moment.

Please post a link to the news story that you refer to here.  Otherwise, I am going to suggest that this entire post is fabricated and utter tripe.

Regardless, OP, I would suggest that you not shoot this girl.  I would not either.

It would seem that you have no idea of what the law might be in your area,
So if I were you I'd probably skip this one.

It can be done legally,
but it is also easy enough to do it in a way that could cause you legal issues.
So either take the time to educate yourself in the law,
hire a good lawyer who is versed in the relevant law.
Or just say no thanks.

I don't have links handy because I'm on my phone, but I think I know which sleazeball in Texas the posts above are referring to. He's a former member, so I don't know if we're allowed to post news anymore. If we are I'll try to dig it up when I get home tonight.

His arrest wasn't a nudity thing per se, there were a couple of related issues IIRC. Unfortunately I know a few of the models we worked with and "managed" (yeah he was one of "those" photographers too).

Lot of misinformation here! For example, age 18 is the age where contracts can be signed legally, and no parent needed, NOT age 21.  Nudes of minors are not always illegal.  If you have to ask, then just don't do it.   Or consult an attorney in your area.

"sexual in nature" can be defined differently by everyone. something that turns me on, might not do it for you. something that makes me gag at the thought or the sight, might make someone else jizz in there pants.

Don't take the risk of getting arrested, law suits, or being labeled a pedophile, or anything equally nasty.

I wouldn't do it unless the model was 18, creates lots less problems then. Give her a deal for her birthday.

Do keep in mind that the release isn't worth anything once she turns 18, wait until she is older and can sign a release.  Other then the hassle of the nut jobs who may claim your work is all sorts of negative things and could lead you into court (or even just damage your rep with the local media) what will you get out of it even if everything goes perfectly?  Maybe some cash and some shots you can use for a little while until you need to get a new release?  If your going to have to see her again at 18 for a new signature you may as well shoot her then.
