At bit complex so I'm not sure I correctly understand all the details, but hopefully this will help:

The photographer has the rights to the photo and can provide usage rights to whomever he/she wishes.

Without a model release, the model has some rights which limit how his or her image can be used, such as right of privacy and right of publicity.  These rights vary a bit from state to state, but often prohibit commercial use.

Nobody but the photographer has any inherent right to images and the photographer can license them as he/she wishes.  Obviously, you can come to any agreement you wish about compensation (including receiving images), crediting, etc.  Note that many publications don't even credit the photographer for images, let alone the other people involved in a shoot.

If you were promised pay, and did not receive it, it does not mean you have any right to images not promised.  It means you have the right to any pay promised.  Small claims court is one option for recovering such pay.
