Let me start by saying I admire your persistence.

Let me continue by making some assertions without citing sources as I'm typing on tiny iPhone and have meeting in 7 minutes.

It is my understanding that the person clicking the shutter has full rights to the image in perpetuity globally in as is or altered condition to use in any way imaginable including undersirable sites and ads for all kinds of dysfunction etc. regardless of compensation.

Then the model releases or understandings under TF* come into play to modify said default.

That's where UCR varies--what is Usual, Customary and Reasonable.

Got to run--I plan to return to flesh this out a bit more. Don't know when.

OK...I have a question.

Some of the photographers I worked with have been incredibly kind in providing me with unedited images AND have given me permission to edit those pictures.  I have verbally agreed with them that I would share the edited photos with them.  Now, this is what I consider to be a collaborative effort.  The photographers may or may not wish to have their names associated with the picture(s) but at least I have them if I wish to use them.

My question is:  is it ok for me to share these photos as they were taken during the group shoots?

Celine

You made an agreement with them, so I would say yes for using the photos as long as you follow the agreement, meaning give them the promised edited copies, and follow any usage restrictions agreed to (such as self promotion only, MM only , etc).

I would not use their name without letting them see the image and then getting permission first.

In communication with dozens of you I just realized that tripod probably not one of ours! It's probably another Carnival guest's. Does any one have a method to transmit the image of found item to her or to Lost and Found? If so, please PM me. [For lurkers: PM is MM lingo for Private Message. Also for fans and afficcianados (sp?)--mixed up luggage can cause a lot of real and expensive problems :-)]

So while we are at it, let's talk releases. Does any one have full text of releases they are willing to release or links to good releases. I have one from a model that is well written but I am not authorized to release.

hm, the release I use is part of an agreement especially crafted to all situations that are relevant to me

it wasn't AT ALL intended for TF shoots, but once it was clear that my agreements were the only ones that would be circulated I got all of them signed...

what I'm saying though is that I don't know if it would be relevant to other content creators and photographers here

Eric I appreciate the thought and quality you used in making your releases. Well crafted and perfect design. Model Release on a Business Card.

If you use it make sure others know Eric designed the practice. So much simpler than an 8 1/2 x 11 piece of paper which just occupies space.

JT, let's not make this so complicated.  I wasn't asking for advice on who owns rights to the photos.  None of the images I got were of any caliber to make any money off of and my intention with these photographs is self promotion.  My agreement with the photographers is what we make it to be considering there was no agreement to begin with.

How about I save you the time and trouble and simply retract my question.  Please do not respond any further.

Fiddling with figures.
[during a meeting--Gary, this isn't taking incremental time].

Rough estimate of cost per image (unaudited):

We had about 70 people allocated to this expedition. [No shows still cost--unrecoverable sunk cost.]
Each person conservatively cost about $1,000 by the time passage is paid for, gratuities, drinks, taxes, all incidentals, travel to pier and back, medical, flights, internet, communication coats, parking, postage, etc...
From page 66 till now I counted approximately 150 UNIQUE images still posted (some have disappeared).
Do the math!
Currently it's about US$500 or about 6,500 pesos per image posted!

Of course, each additional image reduces the per image cost as it spreads the fixed costs.

This doesn't figure in the cost of hardware we assembled and lost (couple cameras drenched).

I haven't figure in the man/woman-years of expertise brought to bear on the prime directive, it's FMV (Fair Market Value), opportunity costs, goodwill, consequential damages, legal fees, etc, ad nauseam, :-).
