So I was reading about a case where a photographer named Lara Jade is suing a company (TVX Films) that stole one of her images from Deviant Nation (a self portrait taken when she was FOURTEEN!!!) and was using it on the cover of a rereleased porn film called BODY MAGIC.

When she asked them why they were doing this they scoffed at her. As she persisted, she got this e-mail:

"I’M SURE BY THE END OF THE MONTH YOUR FACE WILL BE HISTORY. WE HAVE STOPPED SELLING THE DVD UNTIL COVER IS REPLACED. WE HAVE FURTHER CHECKED OUT YOUR NAME AND ITS NOT LIKE IT’S A HOUSE WHOLE NAME. ACTUALLY, REMOVING YOUR IMAGE WILL HE P IMPROVE THE SELL OF THE DVD….. SO FAR IT BOMBED. … AS FOR COMPSENSATION;YOUR SILLY! … THEY ARE REMAKING THE COVER S WE SPEAK SO YOUR TEN SECONDS OF FAME WILL SOON COME TO AN END"

So I go check this company's site out and FIND THIS:

I KNOW that's an image I've seen here on Model Mayhem AND on Myspace used by the person in the photo. Does anyone know who this is?

I only saw this case mentioned once here on Model Mayhem and upon investigating it myself I saw LOTS of potential copyright infringements on the covers of these adult films being rereleased by TVX Films. Many of them may be YOU or shot by you.

I hate to make you go look as many of these have hardcore photos, but it might be worth it, just in case.

Typically porn companies are very good at following the law.

Local governments score big PR points when they arrest or prosecute an adult entertainment company.

Pornography is currently our nations #1 law enforcement priority (above terrorism and drugs).


I would expect a company in the adult entertainment business to be quite willing to pay for a image they used.  It really is to their advantage to avoid a court battle.

These companies usually have a very good understanding of intellectual property laws.  After all, intellectual property is their primary product.


If the image really was taken of a 14 year old, they are some extremely serious child pornography issues.

I don't know the model, but the photographer is Octavio Arizala, more widely known as WinkiTiki, and he had been a MM member (8781). See http://www.winkitiki.com for his main site, which has another image from that session (makeup, model, prop gun) up.

They wanted to steal this photo for an Eastern European porn DVD.

Apparently, because they couldn't agree on the title, it was delayed and someone was able to inform me about the ongoing theft.

AFAIK, the two top titles that caused the delay were:

A. "The Electrician's Kielbasa" vs.

B. "Nobody eats Pirogi as Electrician's do"

I just sent him a note about it.  I got a feeling that these butt plugs think that because the copyright holders are from overseas that they're immune from prosecution.

This is the #1 reason why I've taken A LOT of my work off from DeviantART.....

Image theft is huge online and nothing can stop it, watermarking only helps identify your work but there's still no way to prevent someone from taking your images (sucks) other than making your images small with poor quality to deter the desire to steal them.

I've heard they're cracking the whip hard but lower end "amatuer" porn are going to figure they're below the radar and so won't get slammed with a lawsuit or can drag it out while they figure out what options to pursue.

Also remember even if you haven't registered YET, you can still register. Takes up to 6 months some times. But after those 6 months, THEN you go after the bastards with the lawsuit and they'll settle. Registration makes this much easier. If you're not registered, it's usually a harder to get any restitution.

I just got a reply from the photographer in Russia who took the photo that appears on the cover that I linked above.

He had no idea that they had used it; and he's pissed (mainly because it's being used on a porno).

This company really needs to get sued off the map....

Wouldn't you be bummed if you bought thaqt DVD thinking that ass was Candida(bad name for porno actress, good name for fungal vajayjay) and you discovered that the lady had an ass like a peperoni pizza.  I'm gonna stick to downloads so as to avoid disappointment.

The company stealing these photos for their DVDs IS based in America. And from the e-mail exchanges they did with Laura Jade, sounds like they didn't even care that they stole a picture of a 14 year old for their cover.

PB's has legal representation that deals with that. They've been very active in going after copyright violations. Just send them the information and they will take try to take care of it.

And it's not about pay for it or not paying for it. It's about getting free pictures to use.

I found one of my photos from DA on one of the cover's as well! They grabbed one of my photos from DA apparently. I think it's way funny the photo they choose-- I am inclined to let it go just because of that. I'm laughing my ass off right now!

I REALLY think you should follow up on this though. It's ONE thing if they asked you and you let them use the image for free, but it's another to have them stealing photos from you without even a "we stole your image. Thank you."

Models need to be careful, even if they are doing TFP that they have a contract between them and the photograph that states that the photographer nor the model is allowed to sell those pictures to third parties. Without that contract, someone can sell those pictures because you have no legal rights to it, even though it is your image. You can go to court, but it will be very expensive to sue these companies because they have their asses covered as well. One of the models with my former agency who has a seven page layout in SHOW magazine can me found in the back of urban magazines like Black Men and XXl on the cover of pornos. They chopped off her head, and used ass shots and slapped a pole between her butt cheeks, and now they're making thousands of dollars off of her and she isn't getting paid a dime.

This is the second case I have seen of porn company taking personal pics and making box covers.  She should sue.

I have had photos stolen by some one right clicking then making something from it.

Situations like this explain why I watermark. May not be the best looking for my port but it makes it way more inconvenient to use.
