My guess is that there is nothing illegal on the part of the photog, but NO, it probably would NOT be legal for the model in most jurisdictions.

It would probably be considered to be the model exposing themself to a minor (according to the law) and there are probably statutes against it, even in private.

I could be wrong, but with all the other laws floating around, I would think it would be very risky... for the model.

The photog probably would not have anything happen to him/her.

Likely that if anything came of it, the model would be in more trouble for contributing to delinquency of a minor than the photographer would for taking the photos of the unclothed adult.

As the photographer, do your parents know about and approve of the situation?

I know of no state in the United States where the scenario you describe (and no more, and no less than the scenario you describe) is illegal.

Mind you, this is not legal advice and I worded my answer very carefully.

You already have nudes in your port, so I assume you are either the 21 year old or are asking about someone else.

What you need to do is look into your state law, because I promise you, the answers on here will be varied and won't be of much help to you.

Is it NECESSARY to shoot this model nude?  Will your life and career end if you don't?

If the answer is no, then don't open that can of worms.

I can't see why it would be illegal as long as it is "art" and not "pornography". Those are the technical terms you will probably find yourself facing.

It isn't illegal for a child to be part of a nudist colony. It isn't illegal for a child to enter an art gallery where nudes are present. Why would it be illegal for a minor to create such art?

I don't know the laws. I just have opinions. If it were me, I'd do it. Worst case situation - the 16 year olds spends 2 years in jail . . . .

Here's a scenario, it may not be illegal for the 16 year old to shoot a nude 21 year old, but it may be illegal depending on how the courts interpret it for a nude 21 to be 'exposing' themselves to a minor.

Though I think they have to prove lewd and lavicious intent

Yea some bright minded minors will often accompany a college class to creative figure study without a problem.

Right answer.  It would depend on what you were shooting, state law and some other factors.  I am not a lawyer so you need to talk to a lawyer in the state the young pervert lives in, but my sense is that the bigger risk would be for the model than the photographer.  I can see situations where there could be a claim of "lewd conduct with a minor" or some other similar situations.

But then again, I am not a lawyer.

Go and find out what the age of consent is in your state. 16 is probably most common. If you're old enough to touch her private parts, they could hardly have a problem with you just looking.

when i was in high school there was a summer program for High School Art students at Otis Parsons - we did a lot of figure drawings from nude models...  Seriously folks - the nude is one of the staples of Art..  Some of the things I have read in this thread really reveal who doesn't know anything about Art and photography...

I started shooting nudes just before my 19th birthday, the only under 18 year old photographers (all girls) I know don't shoot any nude/fetish/glamour just in case and are waiting till they are 18.  I wouldn't want the model to get in trouble for exposure or something ridiculous.
