What he's saying here is that there's not necessarily 1 "right" answer to this question. It's going to vary from person to person. Usually in these cases the only answer that matters is the one you choose for yourself.

That said, I would tend to consider it implied.

Agreed.

If this is an "implied" shot then that makes all bodypaint implied nudity. Not in my opinion....if you are bodypainted you are still nude.

This is one of those syntax grey area.  Technically, if the genitalia or nipples can be clearly seen.. It's nude.  Any non-clothing that prevents them from being seen: towel, ribbon, body posture, prop, or appendage.. Technically that's implied if the model is not dressed to society's current standards.  Body paint is a hard area to address.. I've seen body paint done so well that the model can walk out in public because people aren't paying to close attention.. But all it takes is one person to notice and it can be a police issue.

If this was in my portfolio I'd mark it as adult - 18 over only just to be on the safe side of any possible legal issue.

It's like we need to define nude as if you can tell what is there, it's nude or we need another category to cover this case (be it body paint or wet t-shirt or whatever)

it seems like models who don't do nudes will do bodypaint. so for them it isn't nude. to me if i can see nipples it's nude.

as far as mayhem i don't know if you have to mark them 18+ or not. i would be inclined to mark it as NSFW myself.

If you want to know if a model will do a particular idea, ask the model if she'll do it.  The only person's opinion that matters is the model.

Nude or not, it doesn't matter.  Does the OP move in social circles that will judge him for photographing this image?  Does he care?  It will do him no good to argue semantics with his peers.

In my opinion this is Implied, since any 'inappropriate' parts are not readily seen, however I would still mark it as 'NSFW'/'Mature' because there are some audiences that would claim it to be to revealing.
