There are different rules in my state if the nude model in at a art school or just elsewhere.

In a art school it was legal.

Outside it was a no no.

Can a sixteen year old go to a museum in your state and view paintings, sculptures, and photographs of nudes by the masters in your state?

nude art should not be porn, people.
hopefully the OP is talking about making art, not porn.

I must remember, if I ever want legal advice to ask a bunch of strangers who aren't qualified to give me their guesses rather than going to a lawyer, the police, the Citizens Advice Bureau.....

can a 16 year old legally photograph a 21 year old naked? (the 16 y/o will be clothed)

I think you are going to run into a major problem with this.
Corrupting a minor is the first thing to come to mind and there are probably many other problems too.

Here in Richmond, VA we have a school called Open High, which is very non-traditional and arts-oriented.  A few years ago, an Open High student (15 years old at the time) enrolled in some drawing classes at Virginia Commonwealth University for extra credit.  The classes included life drawing from nude models.  One of the kid's parents saw her sketchbooks and raised holy hell, threatening to sue the university for contributing to the delinquency of a minor.  Things were settled out of court and the university revised its policy to not allowing any minor to take life drawing classes unless they were a full time student.  I attended VCU and shot my first nudes for a photography class at age 17.

I love it... Option A) Legal, option B) No no...

ummm does "no no" mean "illegal" .... what are you an idiot... it means "no no"; how can I make it any clearer for you...

I'm off to commit a felony no no, someone hand me my camera.

Legal stuff aside, it sounds like a really bad idea.

The parents may have threatened the university, but it wouldn't have been for "Contributing to the delinquency of a minor."  I hear that bantered around all the time and nobody seems to know what it means.

This would not, under any circumstance be, contributing to the delinquency of a minor.

At 16 I modeled and photographed naked.
Its like what thousands  ... make that millions do on myspace etc.

EL

funnily enough I was reading a news article saying their are increasing numbers of teenagers being charged for producing child pornography, that is the transmission of images of friends/themselves minus their clothes.

Just be aware...

And anyone look at the OP's port?? I hope he is not the 16 yr old in question!
