I think I have a problem. Just discovered that model agency is using my photo without any permissions and without credit. I'm just starting out and of course, I still don't  know many things, but is that ok? I was working with one of their models. She contacted me on her own for a TF shoot and the agency wasn't involved in that. Should I ask them to remove my photo?

I would like to also know, how do you work with agencies? Do you charge them for model shoots, do you work on TF basis and do they credit you as a photographer if using photos on facebook for example?

I do not think you have a problem.

The only thing which would be achieved by asking them to remove your photo is burning any potential future bridges with them.

Why not email them, (I would recommend prefaced with a phone call if you don't know any of the bookers there) saying that you've seen they're using your photo and as they obviously like it you'd be interested with testing/working with the in the future.

I don't work with non-agency models, and all of my bookings are done through agencies.
I charge for testing (TF... does not exist in the industry, it is generally called testing), but not exclusively. It depends on the face and if I have a personal project I want to work on.

It's common courtesy to be credited on social media, but isn't something I would really expect or demand; if I want people to know I shot something I'll share the image and say so.

Thank you for your input.

Basically, this is what I did. Photo was downloaded from my FB page on a mobile phone and quality was just terrible. So I asked them to take this one down and offered to send another one in a good quality. I also see that in my area almost all photographer watermark their photos so the rest of the photos on their page taken by other togs are watermarked. So this is what I offered - watermarked better quality file.

This agency is also willing to work with me. I'm not trying to burn the bridge at all smile I just try to find the best solution I can smile

Glad that worked for you!

For a smaller local agency that sounds acceptable, and in line with what they're doing already..

I'm not a fan of watermarks in any setting, but please don't ever send a larger more known/global agency watermarked images or expect them to use them!

The problem was solved quickly.

Yep, agree.. not a fan of watermarks at all but because this wasn't a paid job, agency is small/local and everybody else is doing this, I'll probably give it a go.

If you want to work with their models then give them whatever they ask for.

They hold all the cards in this game; play by their rules or look elsewhere for models.

I give agencies I work with web and hi-res files, unwatermarked. In return I get to shoot great models for free.

It's not such a bad deal if you take the long view.

I have a similar situation in that I worked with an agency model I found through MM.
She liked the pictures we shot and she sent them off to her agency, with my approval.

The agency liked the pictures and is now using 3 or 4 of them for her book.

The problem is that I've contacted the agency before, they write back then disappear. I've contacted them thanking for using my pictures of the model and to please contact me back because I'd like to test with their models.  They don't write back. sad

Should I post in social media that my picture is being used by xyz agency and link to it?

Sounds good to me. I'm just getting grumpy sometimes when I see that someone is using photos without asking or crediting me. One model even put my photo trough instagram and changed the look. Now this photo looks terrible. Obviously this is what we have to deal with in this social media era smile

Personally, I'd ask her to remove it.

You can (many would say 'should') issue a written license to go with all pictures you give out to models (don't try it with agencies unless they're paying you or you will piss them off) saying what they can and can't do with them.

It's easy to include a clause like:  "No modifications, editing or filters to be applied when posting to Social Media Platforms."

You should also call the booker rather than just emailing them. They're busy people, especially if the agency is a good one, and unsolicited emails from photographers they don't know are not going to get a lot of attention.

I didn't think that I could do that.
I'll post on fb later today!

I always thank them for using my work.  I actually love it. I just wish I could get more work from it.

I'll call the booker later.  I've met with her last year but I think she's so busy that she forgets me.

Edit:  I just got an email from the booker.  It turns out my emails were going to spam. Argh!

Call them and go see them in person, always better to show them you are real.

You're really helpful. This is what I was thinking to do. Some of them are just starting out and don't know the rules at all. So uneducated..

I'd personally be suspicious of how beneficial a relationship with an agency that uses watermarked images on their boards would be.

Post on your page above text saying "Agency approved photographer."

I had an agency steal a photo I took of my sister neither me or my sister were affiliated with the agency I only found out they were using the photo when a photographer messaged me saying hey I saw a poster of this photo in ____________ agency's office. They had downloaded the image from my Facebook fan page without my permission. I wonder how shitty the poster must have looked since the resolution of the file wasn't that big.
