Hi, kinda new to this and was curious if MUA's have their own contracts to use with photographers like models do etc. Basically making sure the MUA get prints, credit, etc.? If so, can anyone suggest further info. Thanks a bunch YB

Yes, a contract is a great idea, especially when you're a professional MUA. I have one contract for models, photographers, filmakers, and actors. They indicate on the contract what they are. A contract will help insure you get paid no matter what happens, since it's legally binding. It can also release you from any liability of injury. This is important because a model who you are working on may be at fault for some injury, but blame you for it. (i.e. they make a sudden move when you are putting eyeliner on them, and get jabbed in the eye, or get burned with a curling iron.) But with this, you must also be as careful as you can. It can be helpful in making sure you get some of the pictures produced, if you put that in a contract. All these provisions in a contract can make things at your shoot go smoother, and protect you as an artist, which should be your first priority. Merril Making Faces

You may want to also consider having a contract when you provide make-up services for an event...not necessarily a shoot. I've had a few instances when I've had to learn about contracts the hard way and it ended up losing me thousands of dollars. Always, ALWAYS, cover your butt!

No idea about the P & P either. Proofs and Prints, maybe. I just officially made out my contracts the other day. I have one for the photo shoot breakdown---which is stuff like contact info, and details about the shoot, and then I have a contract for models to sign--basically stating that I have creative freedom, as well as they can't sue me if they are allergic to something in a product, and didn't tell me, etc. And the most important is the photographer contract. I absolutely HATE hunting down photographers for prints from a shoot over a month ago. They just seem to disappear. Sooo, I let them know that I expect images in no more than a months time. They have the option of either emailing me images, images on CD, or images posted on a website that I can copy and save on my computer. It technically works better to get them on a CD, since you will get FULLSIZE images that you will need for your portfolio. And of course, something in there stating your fee or rate, and who is paying, etc. Get everyone to sign stuff before the shoot.

I think the form is great I am going to incorporate it. I do get nervous about getting pics but I figure if I find someone great to work with I stick with them. I guess the best way to hand over the contract is very forthrightly and with a smile, huh? ;-)

That way you don't have to use the magnifying lens to view them closely... I did not know people still used contact sheets. I guess for film they are used maybe?????

Yesenia As for my service (not photo shoot) contract, make sure to stipulate if travel and room and board are incorporated (if necessary)...in the early days, I had to travel for shifty agencies who said everything was included, but was NOT. For my brides, I have a start time and finish time lined out, anything beyond that goes to an hourly rate. I literally have a "touch-up" clause in my bridal contracts. I have one rate for if I stay in one location the whole time and another higher rate if I have to change locations. (I once had a bride who made me go to her house, the church and the reception.) For commercial work make sure it is very clear that the half-day rate ends at 4 hours and then goes up to a full day rate. Also, make sure it is clear whether or not meals are provided. There are so many factors to consider. I have modified my contracts for years to include bizarre situations I come across. Some of it sounds silly, but like I said before, you have to make sure your butt is covered, no matter what!

When you send the invoice to a client, it is very important that you specify how much you charge for overtime, mileage, perdiem and kit fee, besides your day/hour rate.

Heres a sample of one that I am startingto use It was used on a commerical shoot I just did and I am going to adapt it to my needs. Deal Memo This is a âwork for hireâ agreement between (hereinafter âCompanyâ) and ____Lynn Golovich___, (hereinafter âConsultantâ), agree to the following agreement below. The consultant is to perform the duties of _____Make-up Artist______ on the production entitled _ 1) Flat Rate for Production =_________________ Flare rate includes: ____ travel days, ____ prep days, & ____ shoot days OR 2) At the rate of _ for each of ___ shoot day(s). And ________ for each of ______ travel day(s). And ________ for each of ______ prep day(s). Company shall pay all contracts on a 30 day net payment from day of invoice. The flat rate quoted above (listed as #1) applies to 12-hour shoot days, travel days, and any pre-production. The 12-hour shoot days that are applied to work hours and do not include meal breaks. The rate quoted above (listed as #2) applies to a 12 hour shoot days which are applied to work hours and does not include meal breaks and will be pro-rated on an hourly basis for any overtime incurred at the site. The pro-rated charges will be after 12 hours: double time up to 14 hours. Todayâs Date __________________________________20_____ I __________________the make-up artist, will provide the make-up and (or) Hairstyling on this TFP, TFCD, TEST. I will provide all of the make-up supplies that are needed for this shoot, including Hair supplies, including disposables (sponges, mascara wands, tissues, water ect.) The photographer(s) on this shoot is (are)______________________________________ _______________________________ ____________________________________ The model(s) on this shoot is (are) __________________________________ ______________________________ __________________________________ ______________________________ _____________________________________ In Exchange as âpaymentâ I require the following (please check the boxes that you will provide for me) A copy of the images shot today on a CD or DVD Size(s) 8X10___# of prints, 9X12___#of Prints, 10X13___#of Prints The photographer will provide me with good quality images that can be printed out in any size. If the Purchaser shall fail to notify the Artist of a cancellation in the manner as provided above, or in the event of breach of this agreement, then the purchaser shall remain responsible for the full contract price specified, including all costs expense, damages and fees, (including costs of cancellations, court costs, and reasonable attorneyâs fees) incurred by Artist in enforcing this agreement. _____ (Initial) 4. Purchaser herby agrees to indemnify Artist for any loss or damage to the Artist, itâs personnel, and equipment at the Event Site, provided the loss or damage was caused by person or persons other than the Artist or Assistants. ___(Initial) 5. The Artist shall not be liable for omissions or failure to perform its obligation, when such s through accident, increment weather or caused by events reasonably may be deemed beyond control of the Artist. If the Artist should be materially or physically incapacitated from performing its service for any reason, Artist shall have the option to replace with another qualified Artist recommended by the Artist of this contract. ______(Initial) 6. The Artist makes no warranties and the Artist shall not be liable for any direct and consequential damages arising out of the performance of service under this agreement. _____ (Initial) 7. All persons receiving cosmetic application are urged to book a consultation prior to the event to determine color choices. I of course am just a body artist and a simple manâ¦Who is still working on my contract through the Arts council legal services. They supply artist with legal assistance for free. Something to note in negotiations is we are artist itâs in our very title. The Photographer has copyrights to the images once taken, but not the art, be it body painting or make up. Not without a release. And the copy right for the make up / body art is held by the MUA / Body painter. What does that mean? The photographer can not use or display images of the art in any way shape or form without that release. Because the copy right on that art is held by the artist. The images may not be but the images are worthless without that release. Just a reminder for when things get rough if someone is being nasty. Most photographers that I have seen will not sign usage releases until they deliver the finished product. So as a general rule I do not sign an artist release until I receive my copies and payment. If anything I am working it into the contract that I hold sole rights to the art until such time as the payment is received. At which time the agreed upon share of the rights transfers to the correct party.

Don't forget a good reproduction release that allows you to reproduce the images for your book, for promotional pieces, and/or display them in digital format. A lot of printers won't let you print images for your book or printed materials without one. Here's mine: REPRODUCTION RELEASE I ________________grant to _______(name of artist - include DBA if appropriate)________, permission to copy and/or print my work and use in perpetuity for the following purposes: to display as prints in his/her portfolio, to be printed on his/her promotional piece(s) (e.g., promo cards, zed/comp cards, brochures, printed advertisements, business cards, etc.), to be displayed online for self promotion purposes (on his/her web-site, in online portfolios of the artistâs work, etc.), and/or to be printed in trade and/or consumer magazines that wish to use the photographs to illustrate a story in which he/she is being featured. The granting of rights as stated herein is also extended to the artistâs agency of record. The artist will affix my copyright on a label on the back of the prints in his/her portfolio whenever it is not clearly displayed on the front of the print.
