I shoot for a niche publishing company.  We don't have the budget to work with modeling agencies, so I get all my talent from MM.

I was contacted by a represented model who wants to work with me, saying her agency said it was OK for her to get "small, local" jobs on her own.

Is this accurate, in your experience?  I always understood that agencies required all bookings to go through them, and forbade their models to work or sign a release outside of their purview.

I have worked with agency represented models who contacted me on their own.
No difficulties arose from it.

They would know "if this is accurate."

Good luck finding MM models signed I legit agencies who participate in the fora.

Uhh... No. I wouldn't recommend that at all. I'd be pissed if someone did that. I'm allowed to book my own work, but I don't go throw it in their faces, either.

PLENTY of models have non-exclusive contracts. I have three agencies and am allowed to book all my own work separate from them. If a girl breaks her contract, they will come after her, not you.

Precisely why I wouldn't consider contacting the Guild. Seems like very bad form.

I wasn't concerned about the agency bothering me, just didn't want to be party to any problems the model might be causing for herself.

Both the (reputable) agencies encouraged me to freelance as much as I wanted.  They only got paid on work they found me.  And my freelancing updated their books of me and gave me a name.  It's legit.

I have an agency and a manager, both allow me to book independently from them.

Depends on your contract.

Yup.
I have a non-exclusive contract and am allowed to book my own work outside of my agency.

I've done this with no problems.  If there is a problem it's the model breaking the rules not me.

This could be the situation with any model.  How would you know?

A lot of it depends upon what you're booking independently.
Much of what is being booked on places like MM is below the threshold-of-bother for many legitimate agencies. However, stumble on a "real" gig with serious usage with someone who can afford to pay agency fees (and sidestep your agency) - they might take it a little more seriously. As always - good judgement prevails.

Edit: I just realized you're a photographer - I answered more as if you were the model asking - I won't revise as TDL answered more from the perspective of a photographer initially asking the question.

It's not your responsibility to go through her agency if she's reaching out to you directly.  Yeah, you could be the nice guy and email them, but all that's going to get you is a rate that is probably more than you want to pay.  The agency is nothing more than a middle-man, whose job is to find the model work.  You have no obligation to them, so if the model has reached out to you and is willing to work for your rate then go for it. 

The only worst case scenario is you get a bad rep for going around the agency, but that would probably only be likely if you already had a working relationship with said agency.  I'm assuming you do not so they can't really expect anything from you and as has been stated: The model either has a non-exclusive contract or is breaking the rules.  Neither one is your concern as long as she shows up and performs as you expect for the rate you're offering.
