Last shoot i did, the model was 17, it went fine and she's in my avatar image now.

As long as you are doing age appropriate shots there is nothing to worry about legally.

In fact, funny story. My friend and I worked with a agency model that was 15 or 16, anyway her mom just dropped her off and picked her up again after the shoot. We weren't worried at all.

Great!! So, as I do with everyone that wants to shoot, I try and find out a little on who THEY are so I can keep all my ducks inline here.. ESPECIALLY WITH "18" YEAR OLDS. So, I bounce her email off of the myspace database and get nothing.. so I take and bounce her model name off google and find her page... it says shes 17.

Benefit of the doubt because the myspace picture was so incredibly small it was hard to tell who it was at all... and the location was "California" and there are QUITE a bit of girls in california....[/sarcasm]

yeah im 17 i put down 18 to make things simple because im in foster care. what would need to be worked out?

Should I just drop it and wait a year? What the hell would I need to do here? Would there be some kind of issue taking photos (appropriate for her age) and posting them to my portfolio (inappropriate for her age)??

The girl is truly a find, but Im not going to be on dateline NBC for some bullsh*t.

Return the following letter:

While I personally find nothing wrong with shooting females of any age as I am not a pervert and my purpose is to make art not have sex,  I do not wish to participate in a law-enforcement dog-and-pony show so that your bosses can run for political office on the platform that they are "tough on sex crimes".

Good luck finding some other hapless soul willing to become a crime statistic, and I hope you can write all your quota of parking tickets this month and every month.

Shoot the photos in an age appropriate way with a release, then at least when she turns 18 you will already have a repore with the model and can shoot whatever style she is willing to shoot.

If handled properly, the age of the model should not be a problem.

Sarah, shown below, is 13 years old.  She is one of the young theatre students in may area that I am working with to build their portfolio for comp/zed cards and casting calls.  Her mother or father is present at all sessions and we have lots of fun learning different poses and styles of shots.

She is now in the process of getting an MM account with her moms help.

I am shooting with a young 17 year old model on this upcoming Sunday... her parent/guardian is coming with her and both will be signing the release. It's the first time with an underage model and I hope everything will turn out alright!

I'd say go for it- she's willing, and as long as she can follow the rules and have somewhere there, there shouldn't be a problem. In the end it's up to you though, but it sounds like a good opportunity for both you to help her along, and her to get some photos.

17 and in foster care?  That is a BIG red flag. That makes the State of California her de facto parent. Having been a foster parent I would recommend you stay away from this one. State social workers wield incredible power with little accountability. If a social worker with a suspicious nature hears about a photographer shooting an underage ward of the state they can go on a kiddie porn witch hunt and make your life a living hell with no repercussions if their suspicions are unfounded. They have the power to remove your kids if they suspect you are creating child porn.

The social worker we dealt with as foster parents was obsessed with satanists. According to her as soon as the sun went down there were hundreds of children being abused in satanic rituals in our general area. I'm just glad we weren't in 17th century Salem.
