Photo pirates, when sued, invariably claim their misuse is allowed under the 'fair use' criteria. Article has intelligent discussion of fair use doctrine, including summaries and cites to important recent cases. Useful info and guidance for photographers and people who hire them or buy photos from them.

Thanks for the link

It was good to see Russell Brammer vs. Violent Hues Productions, 2017 and 2019 was overturned in April

The Montana ruling sucks.  THe ruling indicates that nearly any text added to a photograph would be transformative.  Thus any politician or commercial company could transfer an image by adding their stuff to it.

How is that an issue? That just makes it a derivative work and they still need permission to create the derivative work.

How is what an issue?  Care to be more specific in your question?

How important copyright is to each of us is a personal matter.

As an amateur, I don't let the fear of copyright infringers stop me from sharing what I wish to share on the web. I can also appreciate how the abuse of copyrighted works would be seen completely differently by creative professionals.

In comparison to what's on show on Model Mayhem, my photography isn't at a level that warrants my losing any sleep over copyright. If someone unlawfully uses a photograph of mine and I found out about it, what then?
