Hi all,

I need help on a situation;

I did two TFP shoots early December 2012 with a photographer. Before the shoots it was agreed that payment would be retouched images. He said I would get the images just after Christmas and January latest.

I have not got the images back and I have politely asked how its getting along via email, MM message and Facebook. I also called him. He has ignored everything. All these attempted contacts happened between early January and now.

The shoot was really good quality with agency represented models and a reputable clothing designer. What should I do now?

Well, you could build a fire under his ass by explaining that in stiffing you on the TF deal, he retroactively made the shoot a paid affair. You received no compensation for your work. Send him an invoice for your services.

Have you tried contacting the model or stylist to see if they received any photos?

Two months is not unheard of for a photographer to not have given you images, but not responding is very unprofessional.

And Full Price and send a bill to the agency the models came from so they put a fire under his ass as well!
This seems to be happening more and more. Photographers wonder why a model wants a disc at the end of a shoot now a days.

Hopefully you have model info or agency info
so that you can get copies from them ??
But that doesn't let him off, unless hes dead.

Have you asked if he is ill or there was a problem with them  .... or asked for money in liu of images? That might get his attention!

Is he active on FB or here? Has the other members of the team been in contact with him? Does he pick up his phone when you withhold your mobile number?

From your post so far you've skipped A-Y and jump straight to Zed and assumed he's avoiding you and not giving you the photos.

Was the shoot for publication? Maybe there's an embargo on the pictures until they're published...

Other than that, just keep asking politely every few weeks.

This is ashame.

If it was me after one or two emails, one or two phone calls, I would then go to their office or home with a USB and demand images that you agreed upon.

This is usually a situation of Communication or the lack there of either insecurity or malice on the photographers part.

Every photo shoot should come with some sort of written agreement if possible. Especially if it is a shoot with people you just meet and never worked with. "Great fences make, great neighbors". Nothing personal, just business first then we can have all the fun/games you want.

By law you can have a oral agreement, like a written as long as there is agreement in terms and compensation (a trade IS compensation) you have a contract and it is admissible in court. However, unless you have a willing witness to this agreement a written one is far better.

A written agreement just need to state the terms of the agreement and what compensation. Add the names of the principles and their signatures and you have an agreement/contract. Does not need to be formal.

HOWEVER, the next question is when put in this situation what would you do even with a contract? Well, you do have small claims court which is quick, cheap and effective.

If you have no way to force him to give you the images, which you don't, you can either do something to burn your bridges, have someone you'll never work with again who may bad mouth you behind your back, or you can work to keep the relationship good so that there's a chance he might want to do the right thing.

That might mean patiently waiting for far longer than you should have to.

It's reasonable to send a message asking about them, but maybe he's a little insecure or whatever, and a reasonable question makes him unreasonably uncomfortable? The answer is, now you've made him uncomfortable and his response, or lack of, or procrastination, will reflect that.

Is it your fault, should you have known that a reasonable request would cause that? No, but that may be the reality if the situation you're in. How can you best resolve it to get what you want if that's the case?

Tracking down content from slow photographers is my least fav part of the job. This is why there is a very small group of photographers I shoot TP with now, and it's all people I've met and worked with in the past:/
