I need to know the exact laws regarding a 17 year old girl who wanted pics taken of her in her lingerie.  She is not nude and she was just a friend.  She was not a professional model.  I had the pics up on my Myspace portfolio page and she asked me to take them down because she has changed her mind about wanting to show that much of her body.  Also, at the time, she never told me she was 17.  She is sending me a consent form for me to sign and I am willing to sign it, but I don't want to have to take down the lingerie pics as they were good work.  She has mentioned legal action because the pics were "child porn".  I think that's bull.  Please help.

oh man!!! i wanted to be first...

how come people who posts these types of questions don't have any post counts?  do you not read the forums at all???  how about the search feature...

basically, nothing wrong with underage models/girls/myspace whores etc.. in lingerie.  shoo, take a picture of her topless, and it is legal...

the problem you are running into is that she did not sign a release form, a minor release form, so you can't use the images.  regardless if they will win you some huge award, you are SOL unless she gives you the permission...

so, bad you for being a poor planner and not get her to sign anything beforehand.  SHAME on you for not knowing her age.  I don't want to call you out or anything, but are you a GWC?

Get a lawyer. You have opened yourself up to a huge world of hurt. It doesn't matter if you don't think the pics are child porn. You took pictures of a young girl wearing next to nothing. Doesn't matter that she asked you. There are going to be people that are going to see you as a predator, pervert and criminal. Get a lawyer.

#1 You shot a minor
#2 A minor in lingerie is not illegal
#3 YOU'RE signing a consent form?

Now.. Did you happen to check ID when you shot, get a release? If you didn't get a release or check ID (friend or not), it's your fault.

My advise.. Backup the files (HD drive, cd, DVD, etc) then delete them from your myspace, mayhem, OMP and other sites and forget about the work. If you say it's good work, find another model not a minor (because this time you will check ID and get a release)..

OP.. you do not need to get a lawyer. regardless of how dumb your actions were, you do not need to get a lawyer, or seek legal aid.  advice like that will only come from people who know nothing about the law, and want to spread fear to the masses.....  What is the difference between lingerie and bikini?  shooo, some of the bikini outfits actually have less covering than lingerie... how about implied?  more is covered, but she is nude, is that grounds to get a lawyer??? of course not...

She is thinking legal action and child porn and you don't think this guy needs a lawyer? Get a clue! The difference between lingerie and bikini don't matter. When an underage girl makes a claim of child porn people in power are going to listen, facts be damned. This man needs a lawyer, not a discussion about the difference between lingerie and bikini's!

And this is where  professionalism comes in. Professionalism is not just having a nice camera or taking pictures for money. Its about the skill, knowledge and common sense. If something is going to come back and bite you on the ass. Don't do it. There is nothing wrong with shooting minors a lot of pro models are minors. I have 15 year-old in my book thats at Ford, and has more fashion tears then most 10 years older than her. Was I about to shoot her in an inappropriate way. Of' course not.

wow, this is just a grab bag of goodies here.

So let's see, beyond the obvious of - it's creepy for me to hang out with girls that young "as friends" and I'm 26, now I'm going to assume for a min that you're over 23, which would mean it's kinda creepy that you have "friends" that young... but that's beside the point.

I had a "model" friend ask me to take some lingerie pics of her, she was of age, and she also gave me the run around as far as when, where, and how long. She also didn't talk to me for a few weeks and then all of a sudden wanted me to take the picture of her I had up down, I told her to screw off, I took the image down, and I ignored her. If she doesn't want to play nice she doesn't get to play at all.

That being said, you should just have taken them down right away - in fact you shouldn't have put them up in the first place.

But anyway, that's not even the best part...

WHY IN THE WORLD WOULD YOU SIGN SOMETHING! I don't get it, or am I missing something here?

You think "child porn" is bull? Just call her on the bluff and see how your life changes... I'm not saying you taking those pictures was a bad idea. But you taking them of a "friend" sans a release signed by her parents or guardian, and not having an escort or assistant at the shoot. Damn, I wish I had balls like you to call that bluff.

Actually he might need one. If he had her sign a release, but failed to get a parent's signature as well. Minors cannot contract in their name.

It's not the lingerie part he has to worry about.

naw, I'd just suggest he take the pictures down before things get too far, and that he not make a big deal about it. I may also suggest that he just get rid of the pictures, or at the very least get them as far away from public facing that they can.

There will be time to get a lawyer later if things get that far.

they are EXACTLY how i described.. taken on his bed..in his bedroom.. and the girl has on see thru lingerie.. AND.. they are ALMOST POV images.. (point of view..porn style)

i can understand why SHE thinks they are porn.. she porbally didnt know..OR didnt want to upset the photog at time of shoot ..so went along with it.. (BECAUSE SHE IS only 17...and doesnt know how to deal with inappropriate situations yet)
and felt HORRIBLE AFTERWARDS.. and most likely emailed him ASKING to take them down.. and HE is flipping out now.. because they are his "best" erotic shots..

WHICH ARE ILLEGAL.. they arent classy.. or cute.. they are EROTIC style..

I agree. The content is not the legal issue, moral to some. But not having a parent there and signing a release was a huge mistake.
