I went back to read the OP again thinking I was missing something. It is NOT illegal to shoot minors in the nude in the USA. Period. It IS illegal to shoot PORN with minors in the USA. How hard is that to get? Is it wise to expose your business to people who do not know/agree with the law and get sued over this? Probably not.

I agree, how can so many posts be so wrong? I know, internet... This is ironic because I had something similar very recently, though I know it was not a setup. An under age young woman is interested in shooting with me and I said a project I am working on probably would not be good since it is likely to involve nudity. She said "I am fine with nudity if it isn't too explicit or gross." I replied, "while I know what I want to do wouldn't be illegal technically, I do not like the idea that just about anyone else out there could make their own judgment call and cause me trouble. We can shoot nudes in a year, but in the mean time I will keep you in mind if I have anything I will feel will be appropriate." She understood, everyone is happy, how complicated should this be? -Dylan

Considering the terrible fake "tween/internet lingo" I'm guessing cop/Dateline, but if it's not that it's an 11 year old. It is just not possible for someone that dumb to make it to 17. There are just too many opportunities where one's survival depends upon understanding to look both ways before crossing the street...

Dear Underaged Model, No, it's not illegal as such. Yes, there are things that would make it illegal, but simple nudity is often not one of those things. That said, I only shoot models over 18 if, for no other reason, they can irrevocably contract in their own name. That is, being over 18, they can sign the model release and I don't have to worry about the legal pitfalls of contracting with a minor. I'm sure you understand. OP.... Do you shoot nudes of 17 year olds? If so, why are you concerned about this being a set-up? Is this the first time it occurred to you that it it may not be legal, or the first time you were afraid of being caught? Either way.... contact a good lawyer. If not, tell her that you don't do it and to seek legal advice elsewhere.

My 100% standard reply to anyone under 18yo is: " Due to the nature of my work, I only work with models over 18yo. Contact me after you turn 18 and then we can discuss doing a shoot. " on their 2nd and further replies, I write: "As stated in my previous note: Due to the nature of my work, I only work with models over 18yo. Contact me after you turn 18 and then we can discuss doing a shoot. I also check ID before the shoot"

Should probably should just not talk to anybody under 18 if you can help it, set up or no. She doesn't have to have evil plans for it to look bad to somebody and get you involved in trouble you don't deserve. Sure, maybe it would be a paying gig, but personally I don't think it's worth it dealing with a minor without a parent.
